INTELLUX PLATFORM TERMS OF USE

1. PLATFORM PURPOSE

Intellux is a digital marketing platform focused on conversion, aimed at Small and Medium Enterprises (SMEs), including startups and businesses that do not have expertise in paid traffic and conversion.

2. REGISTRATION AND ACCESS TO THE PLATFORM

2.1. 2.1. To use Intellux services, the user must register using a valid email.

2.2. 2.2. The user must grant access to advertising campaign platforms such as Meta (Facebook, Instagram) and Google Ads, so that Intellux can process and optimize campaigns.

2.3. 2.3. The user is responsible for the accuracy of the information provided and for the secure use of their access credentials.

2.4. 2.4. The user can revoke Intellux's access to their Meta and Google Ads accounts at any time, following the procedures defined by these platforms.

3. PRIVACY AND DATA PROCESSING

3.1. 3.1. Intellux collects and processes personal data such as name, email, phone and access credentials to advertising platforms in a strictly confidential manner.

3.2. 3.2. Data processing follows the guidelines of the General Data Protection Law (LGPD - Law No. 13,709/2018), ensuring security and protection of user data.

3.3. 3.3. No collected data will be shared with third parties without the user's due consent, except when required by law.

3.4. 3.4. The collected data is used exclusively for optimizing the user's marketing campaigns and for improving Intellux's artificial intelligence, without direct modification of campaigns without their authorization.

3.5. 3.5. Stored data is kept for the period necessary to provide services and may be deleted at the user's request.

4. PLATFORM USE

4.1. 4.1. The user agrees to use Intellux only for lawful purposes related to the platform's objective.

4.2. 4.2. Using the platform to create, disseminate or promote campaigns that:

• violate Brazilian legislation or the legislation in force in the territory where the campaign is broadcast;
• promote hate speech, violence or discrimination;
• involve fraud or deceptive practices.

4.3. 4.3. Failure to comply with these rules may result in suspension or deletion of the user's account, without right to refund.

5. COPYRIGHT AND INTELLECTUAL PROPERTY

5.1. 5.1. All source codes, algorithms and technologies developed by Intellux are the exclusive property of the company and may not be copied, distributed or used without authorization.

5.2. 5.2. The user retains rights to their own advertising campaigns and data provided to the platform.

6. PLANS, SUBSCRIPTIONS AND PAYMENTS

6.1. 6.1. Intellux offers its services through subscription plans that vary according to the features included. The currently available plans are:

• a. Starter Plan – $599.00/month: includes paid traffic with automated intelligence; conversational avatar (voice and text) to assist in campaign creation; automatic campaign setup based on the briefing generated by the avatar; simplified performance analysis sent by email;
• b. Essential Plan – $999.00/month: includes all Starter Plan features, with complete performance analysis sent by email and WhatsApp; priority support with Intella; continuous campaign optimization with automatic adjustments based on performance; and possibility of meeting with Intella to track results;
• c. Pro Plan – $1,799.00/month: includes all Essential Plan features, with robust performance analysis; design and creativity for high performance; creative analysis with visual and copy suggestions for ad improvement; and possibility of meeting with Intella to track results.

6.2. 6.2. The stated amounts refer to monthly billing and services are made available on a recurring basis according to the contracted plan.

6.3. 6.3. Payments can be made via credit card, debit card or Pix, processed by the Stripe platform.

6.4. 6.4. The user may cancel their subscription at any time, directly through the platform, without penalties, respecting the current billing cycle.

6.5. 6.5. In case of early cancellation, there will be no proportional refund for the unused period. Access to services will remain active until the end of the current cycle.

6.6. 6.6. Intellux reserves the right to update prices and features offered in each plan, with prior notice to the user with a minimum of 7 (seven) days' notice.

7. RESPONSIBILITY AND LIMITATIONS

7.1. 7.1. Intellux does not guarantee specific results in advertising campaigns, as performance may vary according to multiple external factors.

7.2. 7.2. The platform is not responsible for technical problems, third-party failures or interruptions in the services of the advertising platforms used.

7.3. 7.3. The user assumes full responsibility for the content of their campaigns and the consequences of their use.

8. COMPLIANCE WITH META AND GOOGLE ADS GUIDELINES

8.1. 8.1. Intellux follows Meta and Google Ads developer guidelines and is committed to maintaining compliance with these platforms' policies.

8.2. 8.2. Any changes to the Terms of Use that impact how data from Meta or Google Ads accounts is used will be communicated to users in advance.

8.3. 8.3. Users can consult Meta's policies at https://developers.facebook.com/policy and Google Ads policies at https://support.google.com/adspolicy.

9. GENERAL PROVISIONS

9.1. 9.1. These Terms of Use may be updated periodically. Users will be notified of relevant changes.

9.2. 9.2. Intellux operates in Brazil and is subject to Brazilian legislation, including the Internet Civil Rights Framework (Law No. 12,965/2014) and LGPD.
